Any person who is identified by a woman to be the father of her child is mandated by law to give up a portion of his salary to give to the child as a form of support. If a man fails to perform his obligations or is unable to fulfill what is required of him, he might go to jail. Paternity fraud is not just an illusion – it is real and it is rampant. Statistics show that almost 30% of DNA tests performed annually to counter paternity fraud turn out to reveal negative results.

Paternity fraud, though being quite common, is not legally defined as a crime. There is no law in existence that a woman can go to jail if she wrongfully (especially with ill intentions) claims a man is the father of her child. So, how do you as a man, counter paternity fraud? In cases like these, mandatory DNA testing should be implemented.

If we look at the statistics, paternity fraud is most common among parents who belong to the lower socio-economic group. Most often than not, claims that a man is the father of her child has vested interests especially when a man is known to have more money to pay for support. In paternity fraud is an issue where the man is not the only victim; the child is also the victim here. In cases when it is proven that the mother falsely claimed that a man is the child’s father, the child could lose everything – inheritance, support, and other benefits.

This has become such a big concern that several groups have started calling for mandatory DNA testing of all newborn infants. DNA testing is readily available all over the country. It is a simple routine test that can accurately determine a child’s parents. It is known to be 99% accurate. DNA tests are admissible in court. However, in order for a DNA test to be performed, the mother should concur or the court gives out an order. This would still dependent on which state you are living.

Though not all the states have made changes on their paternity laws, some have started to propose new laws to allow for the disestablishment of paternity based on a negative DNA result test. This could be a welcome move, especially, for individuals who have been wrongfully identified and it could be high time to make the real fathers pay.
